Article 1 – Purpose
These General Terms and Conditions of Sale (GTC) aim to define the conditions under which products are marketed by AAYLAA.
The Products offered for sale by AAYLAA are those listed on the e-shop website www.aaylaa.com on the day of its consultation by the customer.
Each product will have a descriptive sheet containing: the price, photograph, available sizes, colors, composition, washing instructions, and specific characteristics. Minor differences between a product and its photographs may exist, particularly depending on the resolution and color definition of the user's screen.
In summary, these GTC aim to determine the terms and conditions of sale, from registration on the site to the payment process, as well as to define the rights and obligations of the parties within this framework.
Article 2 – Acceptance of the General Terms and Conditions of Sale
The GTC are available to visitors and members on the website www.aaylaa.com where they can be consulted directly.
AAYLAA reserves the right to modify its GTC at any time. In this case, the applicable conditions will be those in force on the date of the order placed by the buyer.
Before placing the order, the customer acknowledges having read the GTC and guarantees that they have full legal capacity to adhere to the GTC and agrees to comply with them. This agreement to comply with the GTC is indicated by a checkbox in the Trunk request form available on the Site.
Article 3 – Service Access
The site is normally accessible to Customers 7 days a week, 24 hours a day, all year round, except in the event of voluntary or involuntary interruption, particularly for maintenance needs or force majeure. AAYLAA, by virtue of its activity, is bound by an obligation of means and cannot be held responsible for any damage, whatever its nature, resulting from the unavailability of the site.
Article 4 – Registration
The validation of a visitor's registration automatically confers membership status and creates their personal space
"My account" on the website, containing their personal information and information about their potential orders.
Article 5 – Creating a Customer Account
Some services on the site (request for an alert when the product is back in stock, newsletter subscription) only require an email address. However, any order validation on the site necessarily requires the prior creation of a customer account or a guest account. Any customer can freely and gratuitously create a customer account via the "login" then "create an account" section available on the site.
The creation of a customer account is carried out by the customer by filling out the form provided with their identification data (name, address, telephone number, email address and any other required information). The data provided by the customer is under their full responsibility, control, and direction. The customer undertakes to provide complete, accurate, and updated information, and not to impersonate a third party. The customer undertakes to update the information in their personal space so that it is always accurate.
When creating a customer account, the customer chooses their username (or email address) and password. If the chosen username is already assigned, the system will invite them to choose another one. Usernames and passwords are personal and confidential. The customer is solely responsible for them. The customer undertakes to keep their password secret and not to disclose it under any circumstances and for any reason.
The customer account created by the customer is strictly personal and allows them to identify themselves before being able to subscribe to a service on the site. In case of suspicion of the use of the username and password by a third party, the customer must immediately alert AAYLAA by email (contact@aaylaa.com) to change their password and/or choose to close their customer account.
AAYLAA reserves the right to close any customer account and consequently refuse any subscription to services for a customer in the following cases:
- non-payment of one or more previous service subscriptions,- abusive, unfair, or fraudulent use of the services offered on the site or violating any of the customer's obligations defined in the general terms and conditions. In this case, AAYLAA sends an email to the customer concerned at the email address associated with their customer account informing them of the deactivation of their username and password as well as the closure of their customer account. In general, the customer is informed that they can close their customer account upon simple request from the customer sent by email (contact@aaylaa.com) to AAYLAA.
Article 6 – Personal Data
All information in your account is used only within the scope of your commercial relationship with AAYLAA. It comes from the voluntary registration of your email address, responses to the registration questionnaire when creating your account, and responses to the questionnaire on customer needs and consumption habits. This information is never resold. AAYLAA informs you that it may communicate your data to ensure the delivery of orders by its service providers, certain aspects of after-sales service, and to carry out satisfaction surveys.
Furthermore, your banking information is never in AAYLAA's possession. Transactions are entirely processed by the payment services of Quonto (System Pay / 3D Secure).
Payment by credit card is perfectly secure. AAYLAA has adopted an online payment system that complies with SSL standards, ensuring the confidentiality and security of banking transactions.
In accordance with the provisions of the Data Protection Act of January 6, 1978, you have a right of access, a right of opposition, a right of rectification and/or deletion concerning the information about you. Article 7 – Personal Data
All information provided during your visits to www.aaylaa.com is strictly confidential. AAYLAA undertakes to respect the confidentiality of your
personal data and to process it in compliance with the French Data Protection Act of January 6, 1978. This data will be used by our internal services for the
processing of your order and for communication, particularly through newsletters/email communications.
Article 8 – Pricing
The prices listed in the catalogue are all-inclusive prices in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be passed on to the price of products or services. AAYLAA reserves the right to modify its prices at any time, it being understood, however, that the price listed in the catalogue on the day of the order will be the only one applicable to the buyer. The prices indicated at the end of the order process include order processing, transport and delivery costs.
Article 9 – Orders
Customers who wish to purchase one or more AAYLAA products on the site must identify themselves via their personal account. Once the customer has identified themselves, they can finalize their order by completing the following steps:
Step 1: The customer selects the chosen products and adds them to their cart after selecting the desired size and color. The cart located at the top right of the screen informs the customer of the selections taken into account by indicating the number of products it contains.
Step 2: The customer checks the contents of their cart by clicking on "my cart" to access the summary of their order. The customer can then modify their order (product, size, quantity). The total VAT-inclusive amount of the order, distinguishing on the one hand the price due for the products, and on the other hand the delivery costs, is then indicated in the summary.
Step 3: Once the order has been checked and, if necessary, modified, the customer validates their cart to finalize their order by clicking on "proceed to payment".
Step 4: The customer enters the delivery and billing details. Apart from the date of birth, the address complement, and delivery information, all fields are necessary for the finalization of the order; it being specified that, unless otherwise indicated by the customer, the billing address will automatically be the same as the delivery address. If the customer has already placed an order on the site, they have a customer account. In such a case, they will only identify themselves with their email address and password. The customer then verifies all the information; it is important that the customer fills out the form as accurately as possible to avoid any errors or incidents in the shipment of the ordered item(s). Then, the customer clicks on the validation button to continue their order.
Step 5: Entering bank details. The customer will then access the secure payment screen of AAYLAA's partner. Payment is made online by credit card only. The customer must enter their credit card number, its expiry date, and the 3 digits of the visual cryptogram on the back of their card. If the payment is accepted, the customer will be redirected to an order confirmation screen on the site. In case of payment failure, the customer will have up to 3 attempts to re-enter their bank details. After the 3rd refusal, the customer will be redirected to a screen on the site indicating the payment refusal. The customer will then be invited to contact AAYLAA's customer service to find out the reasons and jointly find a solution to finalize the customer's order.
Article 10 – Payment and Invoicing
Online sale with immediate payment The price of the products purchased is payable in full, on the day the order is placed by the customer. Payment is made online using the following payment methods: Carte Bleue Visa, Mastercard, e-Carte Bleue, bank transfer and CB at the time of order validation by the customer. The authorization request for the card debit is made at the time of order validation on the website, except in the event of server unavailability. AAYLAA reserves the right to make a new debit authorization request if the first one was unsuccessful due to server unavailability.
Invoice relating to the order
The invoice relating to the paid order is sent as an attachment to the confirmation email sent to the customer.
Article 11 – Deliveries
Deliveries are made to the address indicated on the order form. Risks are borne by the purchaser from the moment the products leave AAYLAA's premises. In the event of damage or loss during transport, a reasoned protest must be made to the carrier within three days of delivery. Delivery times are given for information purposes only; if they exceed thirty days from the order, the sales contract may be cancelled and the buyer reimbursed.
Article 12 – Right and conditions of return
In accordance with Article L121-21 of the French Consumer Code, as a consumer (a natural person who places an order with AAYLAA on the www.aaylaa.com website for purposes that are outside the scope of their commercial, industrial, artisanal, or liberal activity), you have a period of fourteen (14) calendar days to exchange or return any item that does not suit you. You do not have to provide a reason to exercise your right of withdrawal. You will not incur any penalty. The Return* procedures are as follows:
Return the unwanted items in the package: the product must be in the same condition as when it was delivered, i.e., tagged, folded, packaged, and not worn outside of trying it on.
Hand the package to the carrier, taking care to keep proof of this collection and the date on which it took place. If this proof cannot be presented at AAYLAA's request, all returned items may be considered purchased and therefore charged to the customer if the collection deadline has not been met.
If the products do not comply with these terms, AAYLAA will be obliged to debit the customer's account for the amount of the non-compliant item(s).
- Please note that return shipping costs are the sole responsibility of the customer.
Article 13 – Warranty
In the event of non-conformity of a product sold, it may be returned to AAYLAA, who will take it back, exchange it, or refund it. All complaints, exchange requests, or refund requests for "standard" orders must be made by post to the following address: 58 rue de Monceau 75008 Paris– France within three weeks.
Article 14 – Intellectual Property
All logos, illustrations, images, characters, presentation methods, graphics, and characters on the site are and remain the exclusive property of AAYLAA. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, any elements of the site. Any simple or hypertext link is strictly prohibited without prior written authorization from AAYLAA. Any unauthorized exploitation of the site or any of its elements will be considered an infringement and prosecuted in accordance with the provisions of articles L.335-2 et seq. of the Intellectual Property Code. You can also access information concerning you and make any necessary corrections directly on the site by logging into your customer account.
Article 15 – Commercial Offers / Newsletters
AAYLAA may send commercial offers and/or newsletters to customers by post, email, or via all the web spaces run by AAYLAA or its partners on social networks, subject to their prior acceptance. Customers who did not wish to receive commercial offers or the newsletter when they registered may change their choice in their customer account. When an internet user registers their email on the site for any proposed service (creation of a customer account, request for additional photos of an AAYLAA product, and an alert when the product is available again), they will automatically be subscribed to the AAYLAA newsletter.
Customers can, at any time, object free of charge to receiving these commercial prospecting emails by clicking on the "unsubscribe" link in each email. When creating their customer account, and if the customer agrees to receive commercial offers and/or the newsletter, the customer will be offered a questionnaire about their needs and consumption habits for the sole purpose of allowing AAYLAA to send them suitable product or look suggestions. Customers who did not wish to complete the questionnaire about their needs and consumption habits when they registered may do so later in their personal account. Finally, you also have the option to unsubscribe from the newsletters offered by AAYLAA with a simple click on the link provided at the bottom of the last newsletter you received.
Article 16 – Archiving and proof
AAYLAA will archive purchase orders and invoices on a reliable and durable medium, in accordance with the provisions of Article 1348 of the Civil Code, and guarantees the customer access to them at any time upon request, in accordance with the provisions of Article L. 134-2 of the Consumer Code. AAYLAA's computerized records will be considered by the parties as proof of communications, payments, and transactions between them. At any time, the customer has the option to print, download, and retain a paper and electronic copy of the general terms and conditions.
Article 17 – Dispute Resolution
The general terms and conditions are governed by French law. In the event of a dispute, AAYLAA and the client will make their best efforts to find an amicable solution. In the event of a dispute, the competent court will be that of the defendant's domicile in France.
